IT IS ORDERED THAT -
1. Under rule 23.8 of the cival procedure rules the court will deal with the application for leave to file a statutory declaration out of time/witness statement without a hearing because the court does not concider a hearing would be appropiate.
2 The application for leave to file a statutory declaration out of time/witness statment to be REFUSED.

NOTE: A party affected by this Order may under rule 75.5 (2) request a review of this decision by a district judge. Such party must apply under Rule 23.10 within 7 days from this date of service.
